Privacy Policy

This Privacy Policy governs the way Blackline Safety ("we," "us," or "our") collects, uses, discloses, and retains personal information obtained from users ("you" or "your") of our marketing website, Blackline Live, and support website (collectively, the "Websites"). This Privacy Policy is in compliance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Europe’s General Data Protection Regulation (GDPR), the EU/US data privacy framework, UK extension, and Swiss/US data privacy framework. By using our Websites, you consent to the data practices described in this Privacy Policy.

Blackline Safety is a processor of information which is controlled by the account administrator for your corporate account. This privacy policy outlines the information we collect from you, how we process and the options for controlling your personal information. For corporate accounts you may need to contact your employer to exercise your rights of access, review, update, correct or delete your information. We will assist you with exercising these rights, as necessary.

1. Information We Collect

We may collect and process the following types of personal information. For a summary of Blackline’s solution portfolio that uses personal information, refer to section 13 below.

  1. Information you provide voluntarily:
      – Contact information (such as name, email address, phone number)
      – Company and job title
      – Demographic information
  2. Information collected automatically:
      – IP address
      – Computing device information (including browser type, operating system, and language preferences)
      – Usage information (such as pages visited, referring/exit pages, and clickstream data)
  3. Information collected by Blackline safety devices and Loner Mobile, and communicated to Blackline Live, our safety monitoring web site that runs on our Blackline Cloud:
      – Safety device and Loner Mobile data communicated to the Blackline Cloud, including but not limited to personal information (including phone number), gas readings, locations and alert events including environmental gas exposure, no-motion, fall detection, SOS and silent SOS events
      – Such data is accessible to authorized users through our Blackline Live user portal that runs on Amazon Web Services with Blackline Analytics reporting and visualization that runs on Microsoft Power BI
      – Contact information (such as name, email address, phone number), company and job title and demographic information.
2. Use of Personal Information

We use the personal information we collect for the following purposes:

  1. To provide and improve our services:
      • Administer your account and communicate with you
      • Respond to inquiries and provide support services
      • Customize and personalize your experience
      • Analyze usage and improve our Websites
  2. To deliver marketing and other communication with your opt-in:
      • Send promotional materials and newsletters
      • Conduct surveys, contests, and other marketing activities
      • Communicate important updates and announcements
  3. To maintain compliance with legal obligations:
      • Comply with applicable laws and regulations
      • Enforce our legal rights and prevent fraud
  4. Provide safety services for Blackline safety devices and Loner Mobile:
      • To be able to call or SMS a user who may be in an emergency situation
      • To provide location awareness for safety reasons
      • For analytics data for organizations to optimize their workflow.

3. Data Sharing and Disclosure

We may share your personal information with third parties in the following circumstances:

  1. Contracted service providers:
    We may engage trusted third-party service providers (“Contracted Service Providers”) to assist us in delivering our services. These providers are obligated to maintain the confidentiality and security of your personal information.
  2. Legal requirements:
    We may disclose personal information if required by law, legal process, or governmental request.
  3. Business transfers:
    In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred as part of the transaction.

4. International Data Transfers
We may transfer your personal information to countries outside of your home country, including Canada, the European Economic Area (EEA), the United States, and other jurisdictions that may not provide the same level of data protection. We will ensure that such transfers comply with applicable data protection laws and take appropriate safeguards, such as implementing standard contractual clauses or relying on other legal mechanisms.

5. Data Retention
We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Upon the termination of your service contract related to cloud-connected safety monitoring devices, we will retain your personal information for a period of three years, unless otherwise required by law or necessary for legitimate business purposes.

6. Your Rights
You have certain rights regarding your personal information, subject to applicable law. These rights include the right to access, rectify, or delete your personal information, and the right to restrict or object to certain processing activities. To exercise these rights, please contact us using the information provided in Section 8.

7. Security
We are committed to maintaining a secure environment, to host your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8. EU-US Data Privacy Framework
Blackline Safety complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Blackline Safety has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the collection, use (processing) and retention of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.

Blackline Safety has also certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) regarding the collection, use (processing) and retention of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the corresponding DPF Principles shall govern. 9. Control over your data
Pursuant to the DPF, EU, UK and Swiss individuals have the right to access, review, update, correct, and delete your information if it has not been treated according to the DPF Principles. Individuals can exercise these rights from your Blackline Live account or by contacting us at privacy@blacklinesafety.com. You may also choose to limit the information you provide to us under your account settings. If we require a piece of information in order to provide our contracted services to you, the impact of not providing this information will be made clear during your onboarding services provided by our Client Implementations team, or at the point of data entry within the corresponding Website. We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our Contracted Service Providers, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

10. Privacy requests
To request to limit the use and disclosure of your personal information, please submit a written request to privacy@blacklinesafety.com. You may also choose to limit the information you provide to us under your account settings. If we require a piece of information in order to provide our contracted services to you, the impact of not providing this information will be made clear during your onboarding services provided by our Client Implementations team, or at the point of data entry within the corresponding Website. We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our Contracted Service Providers, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to privacy@blacklinesafety.com.

Blackline Safety remains responsible and liable  under the EU-U.S. DPF and UK extension and/or the Swiss-U.S. DPF if a third party that we engage with processes personal information on our behalf in a manner inconsistent with the DPF principals, unless Blackline proves that it is not responsible for the matter causing the damage.

11. Privacy complaints 
In compliance with the DPF Principles, Blackline Safety commits to resolve complaints about our collection or use of your personal information. European Union, United Kingdom, and/or Swiss, individuals with inquiries or complaints regarding our DPF policy should first contact Blackline Safety at: privacy@blacklinesafety.com

Blackline Safety has further committed to refer unresolved DPF complaints to BBB Data Privacy Framework Services, an independent dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers for more information or to file a complaint. The services of BBB Data Privacy Framework Services are provided at no cost to you.

If your Data Privacy Framework complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. The Federal Trade Commission (FTC) has jurisdiction with investigatory and enforcement authority over Blackline Safety USA Corp.’s compliance with the Data Privacy Framework.

12. Changes to this Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. Any changes will be effective immediately upon posting the updated Privacy Policy on our Websites. We encourage you to review this Privacy Policy periodically for any updates.

By using our Websites after any changes to this Privacy Policy, you acknowledge and consent to the updated practices outlined herein.

  1. Blackline Live user portal:
      • Our primary interface for safety monitoring, general reporting and visualization and configuration management
      • Operates on our Blackline Cloud (hosted by Amazon Web Services) 
  2. Email and text message notification and alert services:
      • Provide alerts and notifications related to employee-worn devices
      • Operate on our Blackline Cloud (hosted by Amazon Web Services)
  3. Blackline Analytics delivered through our Blackline Live user portal:
      • Includes Essentials Reports (includes our Gas Detection Chart asset) and Custom Reports  
  4. Blackline Analytics delivered through email services:
      • Includes Essentials Reports (includes our Gas Detection Chart asset) and Custom Reports
  5. Blackline 24/7 live monitoring:
      • Delivered through our Safety Operations Center and Alarm Receiving Centre partners
  6. Software APIs:
      • Interfaces for clients and partners to develop software applications   
      • Operate on our Blackline Cloud (hosted by Amazon Web Services)
  7. Blackline's Loner Mobile app:
      • Personal Safety App for iPhone® or Andriod™
